Mortgage Broker Practices Act Rulemaking - WAC 208-660-550 (Department Fees And Costs)
The fees sections of the rules implementing the Mortgage Broker Practices Act must be amended to not contravene I-960.
Updates
- On June 30, 2008, DFI filed a CR-103 (PDF)* adopting the amendments. The amendments (PDF)* become effective August 1, 2008.
- On April 23, 2008, DFI filed a CR-105 (PDF)* notice of expedited rulemaking to amend the fees section in the MBPA that was inconsistent with I-960. The rule amendments (PDF)* was published in the Washington State Register May 7, 2008, and if no objection is made, will become effective July 25, 2008.

Mortgage Broker Practices Act Rulemaking - WAC 208-660-006 (Definitions) and WAC 208-660-008 (Exemption From Licensing)
Certain sections of rules implementing the Mortgage Broker Practices Act must be amended to not contravene SB 6471, laws of 2008.
Updates
- On May 20, 2008, DFI filed a CR-103 (PDF)* adopting the rule amendments. The rule amendments become effective June 20, 2008.
- On March 18, 2008, DFI filed a CR-105 (PDF)* notice of expedited rulemaking to amend certain rules in the MBPA that were inconsistent with SB 6471. The rule amendments (PDF)* will be published in the Washington State Register April 2, 2008, and if no objection is made, will become effective May 20, 2008. Please note that the rule amendments sought under this rulemaking under WAC 208-660-008 (5) – (8) amend sections amended by the rulemaking linked on the recently adopted rules page under “Adopted Amendatory Language.”

Rulemaking has begun to implement the applicable Laws of2008 (SHB 2770, SB 6471, SB 6381), and to make other amendments.

DFI is proposing to amend the rules on annual reporting.

- On July 10, 2008, DFI held a public hearing on the proposed amendments. Audio from hearing (WMA). The comment period is open until 5:00 P.M. on July 18, 2008.
- On June 4, 2008, DFI filed a CR-102 (PDF)* and the proposed amendatory language (PDF)*.
- On February 04, 2008, DFI filed a CR-101 (PDF)* proposing to amend the rules on annual reporting.

Rulemaking Hearing
Consumer Loan Act Rulemaking - WAC 208-620
DFI is seeking to amend the rules for clarity and consistency in implementing RCW 31.04 and to reflect current industry practices.
Updates
- On June 26, 2008, DFI held a public rulemaking hearing on the CR-102 filing. Audio from hearing (WMA). Comments were accepted through July 7, 2008.
- On May 20, 2008, DFI filed a CR-102 (PDF)* with proposed rule amendments (PDF)*. This rulemaking began in 2007. There are substantive changes to the bonding requirements in section 320, and to the advertising rules in section 630. Other amendments are technical.
- On March 15, 2007, DFI filed a CR-101 (PDF)* seeking to amend the rules for clarity and consistency in implementing RCW 31.04 and to reflect current industry practices.
