Mortgage Broker Practices Act – Increasing the Number of Washington Specific Prelicensing Education Hours
About: DFI has adopted rules increasing the number of prelicensing education hours required for mortgage loan originators prior to licensing. The addition of two hours brings the total number of hours specific to Washington law to four.

Check Cashers and Sellers Act – Small Loan Agents
About: DFI has amended the rules (chapter 208-630 WAC) under the Check Cashers and Sellers Act. Rulemaking was needed to make the rules consistent with the Act and to clarify for the industry which activities of a small loan agent trigger a licensing requirement.
Note: This rule was proposed under an expedited rule-making process that eliminated the need for the agency to hold public hearings, prepare a small business economic impact statement, or provide responses to the criteria for a significant legislative rule.

Some licensees formerly operating under chapter 31.45 (the payday lending law) begun offering products under the Consumer Loan Act that mirror small loans, but with unconscionable terms that fail to provide the protections of the payday lending law. This emergency rule serves as a stopgap to allow DFI to protect the welfare of the public while seeking a more permanent solution through rulemaking or the legislature.

Section 6 amends the annual assessment formula. If the rules were not amended by July 1, 2010, the existing annual assessment formula in the rules would have been inconsistent with the law as amended by chapter 73.
